These terms govern your use of Avery, a conversion rate optimisation tool for Shopify merchants. By connecting your store, you agree to these terms.
1. What Avery does
Avery analyses your Shopify storefront to identify conversion issues, drawing on evidence from documented experiments. It can suggest theme code changes, which you review and approve before anything is applied to your live store.
2. Your store, your control
- Avery requests the Shopify permissions shown to you at connect time. These include permission to install a web pixel that measures visitor behaviour on your storefront, which is installed when you connect, and permission to edit your theme, which is used only to write changes to a copy of your theme for your review.
- No theme change reaches your live store without your explicit approval. Every proposed change is shown as a diff you can review. A published change can be reverted while it remains the most recent theme publish; a revert restores the theme that was live immediately before it.
- You can disconnect your store at any time from the Settings page. The OAuth token is revoked immediately.
- You can delete all your data at any time. Deletion is immediate and irreversible.
3. What we promise
- Every finding cites the experiment behind it. We do not present generic best-practice advice as evidence-backed recommendations.
- Confidence levels are assigned by evidence tier, not by the AI model. A model-generated finding is capped at medium confidence; only findings backed by first-party experiments can claim high.
- Theme edits pass through mechanical guardrails: file allowlists, syntax validation, and bans on scripts, external resources, and checkout modifications.
- Your access token is encrypted at rest and never loaded into a page, an API response, or a log.
4. What we do not promise
- Avery identifies opportunities based on experimental evidence. We do not guarantee that any specific change will increase your conversion rate. Results depend on your store, your traffic, and your customers.
- AI-generated code suggestions are proposals, not instructions. You are responsible for reviewing and approving them.
- We aim for high availability but do not guarantee uptime. Avery is a standalone app, not a Shopify-embedded service, and is subject to its own infrastructure.
5. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or redistribute the analysis output.
- Use Avery to analyse stores you do not own or have authorisation to manage.
- Attempt to access other merchants’ data through the API or interface.
- Submit false or misleading information during onboarding or support interactions.
6. Intellectual property
The analysis rules, evidence inventory, scoring methodology, and application code are ours. Your store data, theme code, and products are yours. Theme edits we generate become yours the moment you approve them.
7. Pricing and billing
Avery is free during the early access period. When pricing takes effect, we will notify connected merchants at least 30 days in advance. Billing will be through Stripe, not through the Shopify App Store.
8. Liability
Avery is provided "as is". To the maximum extent permitted by law, our total liability for any claim arising from your use of Avery is limited to the amount you paid us in the 12 months before the claim.
We are not liable for lost revenue, lost profits, or indirect damages arising from a theme change you approved, a finding you acted on, or downtime.
9. Termination
Either party can terminate at any time. You terminate by disconnecting your store. We may terminate your access if you violate these terms, with reasonable notice when possible.
On termination, your data is handled as described in our Privacy Policy.
10. Changes to these terms
We may update these terms. Material changes will be communicated to connected merchants via email at least 14 days before they take effect.
11. Governing law
These terms are governed by the laws of Australia. Disputes will be resolved in the courts of Victoria, Australia.
